{"id":20710,"date":"2018-06-27T12:15:02","date_gmt":"2018-06-27T16:15:02","guid":{"rendered":"https:\/\/participatorymedicine.org\/epatients\/?p=20710"},"modified":"2018-06-27T12:17:57","modified_gmt":"2018-06-27T16:17:57","slug":"medicare-holds-out-promise-of-health-record-access-revolution","status":"publish","type":"post","link":"https:\/\/participatorymedicine.org\/epatients\/2018\/06\/medicare-holds-out-promise-of-health-record-access-revolution.html","title":{"rendered":"Medicare Holds Out Promise of Health Record Access Revolution"},"content":{"rendered":"<p><em>This is the second of two posts about this important policy issue regarding portability of our medical records. <a href=\"https:\/\/participatorymedicine.org\/epatients\/2018\/06\/spms-comments-on-important-proposed-cms-interoperability-rules.html\" target=\"_blank\" rel=\"noopener\">The first<\/a> provided background, with link to a PDF of the comments SPM submitted, largely authored by Michael Millenson, who provides this essay for context.<\/em><\/p>\n<p>The Trump administration is proposing to use a powerful financial lever to push hospitals into making the patient\u2019s electronic medical record interoperable \u2013 that is, readable by other care providers \u2013 and easily available to patients to download and organize via an app.<\/p>\n<p><!--more-->The possible new mandates, buried in a 479-page <a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/FR-2018-05-07\/pdf\/2018-08705.pdf\">Federal Register \u201cNotice of Proposed Rule Making\u201d<\/a> from the Centers for Medicare &amp; Medicaid Services (CMS), could become part of hospital \u201cconditions of participation\u201d in Medicare. That means if you don\u2019t do it, Medicare, which accounts for about a third of an average hospital&#8217;s revenues, can drop you from the program.<\/p>\n<p>In a comment period that closed June 25, we at the Society for Participatory Medicine registered our strong support for taking the administration rhetoric heard earlier this year, when White House senior advisor Jared Kushner <a href=\"https:\/\/www.healthcareitnews.com\/news\/jared-kushner-says-trump-administration-has-new-plan-interoperability\">promised<\/a> a \u201ctechnological health care revolution centered on patients,\u201d and putting it into practice. The American Hospital Association (AHA), on the other hand, while professing its support for the ultimate goals of interoperability and patient electronic access, <a href=\"https:\/\/www.fiercehealthcare.com\/tech\/aha-cms-conditions-participation-interoperability-medicare-medicaid?mkt_tok=eyJpIjoiTkRWaU5EazBZVEZpTXpCaCIsInQiOiJtOHQwN3hWWWhGRFIzSW5PemxEM25HNnpFNHhrcytGbFNtSHRCSXpab09kQTBrMXNiT0N4VlFYWmpiR2hlWFRRUUEzYVVjZTNVcyt1dFpqTFpyd2lDMGJpeFhsMXN3c0lhZFwvOWJnXC9GWjhPYTI4SHdRU3BZaTZGWUNiam5BODlOIn0%3D&amp;mrkid=4601496\">was equally strong<\/a> in telling CMS it was going too far, too fast and with too punitive an approach.<\/p>\n<p>Not surprisingly, however, the AHA did approve of CMS\u2019s proposal to drop from hospital \u201cMeaningful Use\u201d rules various requirements, such as having at least one patient view, download or transmit their information electronically. SPM, on the other hand, said the requirements should be toughened. The original rule under the Obama administration had been 5 percent of patients before being weakened in response to industry protests. We felt that requiring hospitals to involve at least 10 percent of patients sent a message without being onerous.<\/p>\n<p>What will CMS do? The public comments section available on the web wasn\u2019t current, so we can\u2019t be sure who weighed in, but when we looked we found no groundswell of consumer and patient support. Unfortunately, as I\u2019ve written previously, <a href=\"http:\/\/www.engagingpatients.org\/patient-rights\/patients-lack-political-power-torpedoes-power-sharing\/\">patients do a poor job of wielding political power<\/a> with the exception of the \u201cdisease groups,\u201d clamoring for \u201cthe cure\u201d or better insurance coverage. (Irony:\u00a0 the photo above shows a 1968 &#8220;Youth For Nixon&#8221; brochure, wondering whether citizens were paying attention.)<\/p>\n<p>SPM chair and co-founder Dr. Danny Sands and I met with CMS officials before filing our comments. We believe the agency wants to change not only hospital care, but the sharing of medical information electronically by doctors, ambulatory care centers and everyone else. However, by law the government has to follow a step-by-step process and be precise in its requirements.<\/p>\n<p>What does \u201chealth information\u201d mean? We think patients want the complete medical record. What is the meaning of \u201ctimely\u201d access or \u201creasonable fees\u201d? We think within 24 hours and no fee at all for electronic transmission. Will the record be readable by an API? We think it should be. Will interoperable truly be interoperable, and how quickly? We, obviously, want all of this to happen as soon as possible.<\/p>\n<p>The AHA raised security concerns in relation to patient information readable by an API. However, Deven McGraw, a former senior privacy officer for the Department of Health and Human Services and now at Ciitizen, put those concerns into context in an email:<\/p>\n<blockquote><p>The notion that these security risks \u2013 yes, they exist \u2013 are either insurmountable or are too hard to address is directly contradicted by the actual experience of Apple and its provider partners who are actually doing this now.<\/p><\/blockquote>\n<p>Back in the early 1970s, when even hardline conservative President Richard Nixon was trying to be empathetic, <a href=\"https:\/\/www.nejm.org\/doi\/pdf\/10.1056\/NEJM197309272891311\">a Sounding Board in the <em>New England Journal of Medicine<\/em><\/a> bemoaned the unjustified \u201csuspicion\u201d the women\u2019s health movement expressed about doctors, but suggested a remedy. Giving patients \u201ca complete and unexpurgated copy of all medical records, both inpatient and outpatient,\u201d the article said, \u201cwould enable patients to be much more autonomous in making judgments and choices; less dependent, they would feel less paranoid.\u201d<\/p>\n<p>Nearing a half-century later, the good news is that many of today\u2019s physicians support that access in the spirit of partnership, and even opponents wouldn\u2019t dare call the request \u201cparanoid.\u201d The bad news is that while patients do have that access in theory, the reality is often much different.<\/p>\n<p>As for the AHA, in 1973 <a href=\"https:\/\/participatorymedicine.org\/journal\/evidence\/reviews\/2011\/06\/21\/spock-feminists-and-the-fight-for-participatory-medicine-a-history\/\">it agreed to a patient a \u201cbill of rights\u201d<\/a> guaranteeing patients such rudimentary information as their diagnosis and the names of all treating physicians! Even that grudging move, however, came only after the threat of Congressional action. Speaking of Congress: while the CMS public comment period is over, comments from your Congressperson and Senator, prompted by you, can still have a powerful impact.<\/p>\n<p>I understand the hospital industry\u2019s fears. If you make the patient\u2019s record portable in an electronic \u00a0format readable by any competitor or usable for analytics by a smartphone app, you lose control. Theirs is an economic reaction, and the CMS response should be equally bottom line:share information or lose the biggest chunk of your revenue.<\/p>\n<p>It\u2019s a remedy that\u2019s just what the doctor \u2013 I mean, the patient \u2013 ordered.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This is the second of two posts about this important policy issue regarding portability of our medical records.
